  • Choose a hotel in a good location. Don’t go to hotels which are too far from the city.
  • Do check the ratings and reviews of the hotels before booking
  • Do not book too cheap hotels. Cheap hotels often provide poor services and not good for stay.
  • Book OYO operated hotels like OYO Flagship. They are much safe and secure.

Moreover, police raid only on getting tips for any illegal activities in the hotels. Since most of the hotels OYO and StayUncle partner with are reputed, chances are very low of the police carrying any raid during your stay.

What To Do If Police Raid OYO Rooms

First thing you should understand that you haven’t committed any crime and you need not fear. Be strong and put your words with confidence.

Let the policemen know that you are an informed citizen who knows his/her rights.

Now, if the police raids and starts questioning you, you have the right to know why you are being questioned. Ask for their ID proofs to verify if they are actual policemen. You have the right to ask for ID cards of policemen.

Charging Under IPC Section 294

A person is charged under IPC section 294 for any obscene act in public. Basically, it is for any sexual act in public. Since the police have no charges against you, the first they do is frame you for indecent behavior. But booking a hotel is not an obscene act.

You have booked a hotel for your own privacy and it is not a public act. This is a private thing and you cannot be booked under this section at all. You cannot be booked legally and the police is harassing and misusing its power.

Charging under IPT Act

The Immoral Traffic Prevention Act or IPT Act is to prevent illegal human and child traffic cases.

The police may also try to book you under this act for carrying illegal prostitution or for being with someone who is involved in prostitution in public places.

But you both are mature adults who are in no way involved in prostitution. Also, where you are staying in a private place and not a public place. Thus, you cannot be booked under IPT Act in any way.

What To Do If They Ask You To Call Your Parents

This is something that policemen have no right to do. But they do so and it is a clear case of moral policing. They know that fact that giving a call to your parents will land you in a problem.

Calling your parents is a breach of privacy which is your fundamental right listed in article 21 of the Indian Constitution.

According to the privacy law, mentioned in section 72 A, if someone invades your privacy, they can be imprisoned for up to 3 years and can be fined for up to 5 lakh rupees.

So, Do Not  Fear. You Haven’t Done Anything Wrong!

  • Do not give your phone number or your parents’ number if they ask for it.
  • Ask them why they want the number. Tell them you are there to answer all their questions. You are an adult and you are the one responsible for yourself. They don’t need to talk about it with anyone.

No women can be arrested after the sunset. Even under special circumstances, a female constable and special permission from the Judicial Magistrate of the first class are required.
